Employers Group or Trade Association may adopt special conditions by
mutual agreement, in writing, regarding hours of work, overtime, travel
allowance and other working conditions on a project basis to better
enable them to provide service to specific industrial in-plant sites where
it is mutually advantageous. Any such Agreement will be in writing
between the Local Union having jurisdiction in the area of the project or
projects and the Local Construction Association or Trade Association,
which is a party to the Trade Appendices of this Collective Agreement.
ARTICLE 8 - JURISDICTIONAL DISPUTES
8.01 When a work claim dispute arises between the Local Union and/or
Council, which is a party to this Agreement, and any other Union, person
or organization, which cannot be settled to the satisfaction of all parties
concerned, such dispute shall only be processed as a complaint under
Section 99 of the
Ontario Labour Relations Act
. In the meantime, work will
continue as assigned to the Labourers by the Employer unless otherwise
directed by the Ontario Labour Relations Board.
ARTICLE 9 - RECOGNIZED HOLIDAYS AND
VACATIONS
9.01 All work performed on Sundays and the following recognized
holidays shall be paid at double (2x) the regular rate of wages:
(a) New Year's Day
Labour Day
Good Friday
Thanksgiving Day
Victoria Day
Christmas Day
Dominion Day
Boxing Day
Civic Holiday
Family Day
