ARTICLE 5 - MANAGEMENT RIGHTS
5.01 The Union agrees and acknowledges that the Employer has
exclusive right to manage the business and to exercise such right without
restriction, save and except such prerogatives of management as may be
modified by the terms and conditions of this Agreement. Without
restricting the generality of the foregoing paragraph, it is the exclusive
function of the Employer:
(a) To determine qualifications, classify, transfer, hire, direct,
promote, demote, layoff, discipline and discharge for just cause,
employees and to increase or decrease or transfer working forces in
accordance with the terms of this Agreement. In matters of formal
discipline, including discharge for cause, the employee shall be entitled
to the presence of a Union Steward or Representative during the
disciplinary process. It is agreed that the absence of such Union Steward
or Representative shall not be a bar to the application of discipline.
(b) To determine the materials and methods to be used, design of
the products to be handled, facilities and equipment required, the
scheduling of the work and the locations of equipment.
(c) To determine reasonable rules and regulations to be observed
by employees.
5.02 It is agreed that none of the foregoing shall be exercised in a
manner inconsistent with the express provisions of this Agreement.
ARTICLE 6 - PRE-JOB OR JOB CONFERENCE
6.01 A job conference may be called in writing, on all projects and the
parties agree to meet within fourteen (14) days of notice.
